1.  About this policy

LOCATION RE PTY LTD (Location, we, us, our) is a licensed real estate agency based in Caringbah, NSW. We are bound by the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Act).

This policy describes how we collect, hold, use, and disclose personal information across all of our services. It is intended to satisfy our obligations under APP 1.4 of the Act.

For personal information collected specifically at open for inspections, please also refer to our Privacy Collection Notice — Open for Inspection, available at each inspection and from our office.

2.  What personal information we collect

The kinds of personal information we collect and hold depend on the nature of our engagement with you. This may include:

Identity and contact information

Your name, address, telephone number, email address, and date of birth.

Property-related information

Information about properties you own, are selling, purchasing, or renting, including property addresses, sale prices, rental amounts, and settlement details.

Financial information

Banking details for the purpose of processing rental payments, bond lodgements, or sale proceeds. This information is collected only where necessary and held securely.

Employment and identification

For rental applications, we may collect proof of identity, employment details, income verification, rental history, and references.

Enquiry and preference information

Your property requirements, buying or selling intentions, inspection attendance records, and communication preferences.

Device and website information

When you visit locationre.com.au, we automatically collect information about your device, browser, IP address, pages viewed, referring websites, and how you interact with the site. 3.  How we collect personal information

We collect personal information through the following means:

(a)   directly from you, including at open for inspections, through enquiry forms on our website, by telephone, email, or in person at our office

(b)   through our website and digital platforms, including cookies and analytics tools

(c)   from third parties, including solicitors, conveyancers, mortgage brokers, other real estate agents, referees (for rental applications), and property data providers

(d)   through our customer relationship management (CRM) system and email marketing platform, where your information is stored and managed

Where it is reasonable and practicable to do so, we collect personal information directly from you. We will notify you at or before the time of collection, or as soon as practicable afterwards, in accordance with APP 5.

4.  Purposes of collection, use and disclosure

We collect, hold, use and disclose personal information for the following purposes:

Property sales

To market, appraise, list, and sell properties on behalf of vendors. To manage buyer enquiries, schedule inspections, facilitate negotiations, and coordinate exchange and settlement.

Property management

To manage rental properties on behalf of landlords, including tenant selection, lease administration, rent collection, maintenance coordination, and bond management.

Project marketing

To market new developments on behalf of developers, including managing buyer interest lists, coordinating expressions of interest, and facilitating sales.

Buyer’s agent services

To search for, evaluate, and negotiate the purchase of properties on behalf of buyer clients.

Market communications

To send you market reports, suburb snapshots, property alerts, and other information about the local property market that may be relevant to you. You may opt out of these communications at any time.

Business operations

To manage our internal records, comply with legal and regulatory obligations, respond to enquiries, improve our services, and generate anonymised market statistics.

We will not use or disclose your personal information for a purpose other than those described above unless we have your consent, or as otherwise permitted or required by law.

5.  Who we disclose personal information to

We may disclose your personal information to the following categories of recipients:

(a)   property vendors or landlords, to the extent necessary to report on buyer or tenant interest and to facilitate transactions

(b)   prospective buyers or tenants, to the extent necessary to facilitate a property transaction

(c)   solicitors, conveyancers, and financial institutions involved in a property transaction

(d)   third-party service providers who assist us in delivering our services, including our CRM platform provider, email marketing provider, website hosting provider, and IT support

(e)   government bodies, regulatory authorities, or as otherwise required or authorised by law

(f)    development partners, where we are engaged to market a project on their behalf, and only to the extent necessary for that engagement

We do not sell personal information to third parties.

6.  Overseas disclosure

Some of the third-party platforms we use to manage client communications and store records are operated by companies based outside Australia, or host data on infrastructure located outside Australia. As a result, your personal information may be stored on or accessible from servers located in the following countries:

(a)   United Kingdom — customer relationship management (CRM) platform, hosted on infrastructure distributed across Australia and the United Kingdom

(b)   United States — email marketing platform, workflow automation platform, AI tools, and design platform

The United Kingdom maintains a data protection framework (UK GDPR) that provides protections substantially similar to the Australian Privacy Principles.

Before disclosing personal information to any overseas recipient, we take reasonable steps to ensure that the recipient does not breach the APPs, or that the recipient is subject to a law or binding scheme that is substantially similar to the APPs and that you can access to enforce the protection of your information.

We will update this section if additional overseas disclosures become applicable.

7.  How we store and protect your information

We take reasonable steps to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification, or disclosure. These steps include:

(a)   restricting access to personal information to authorised personnel on a need-to-know basis

(b)   using password protection, access controls, and encryption where appropriate

(c)   maintaining security software on all devices used to access personal information

(d)   storing hard copy records securely at our office

(e)   providing security awareness guidance to all persons engaged in the business

When personal information is no longer required for the purposes described in this policy, or as required by law, we will take reasonable steps to securely destroy or de-identify it.

Our information security practices are further detailed in our internal Information Security and Privacy Procedures Policy, which governs how all persons engaged in the business handle information assets.

8.  Cookies and website analytics

Our website (locationre.com.au) uses cookies and similar technologies to improve your experience and to understand how visitors use the site. These technologies may collect:

•     your IP address, browser type, and operating system

•     the pages you view and how you navigate the site

•     referring websites and search terms

•     date, time, and duration of your visit

This information may be combined with other users’ data in anonymised form to generate statistics about website usage and the types of properties visitors are searching for. It is not used to personally identify you unless you voluntarily provide your details through a form on the site.

You can disable cookies through your browser settings. Please note that disabling cookies may affect the functionality of the site.

9.  Accessing and correcting your information

Under APPs 12 and 13, you have the right to request access to the personal information we hold about you and to request correction of information that is inaccurate, out of date, incomplete, irrelevant, or misleading.

How to make a request

To request access to or correction of your personal information, contact our Privacy Officer using the details in Section 12 below. Please provide sufficient detail to enable us to identify the information you are requesting.

Our response

We will acknowledge your request within 7 days and provide a substantive response within 30 days. Access will be provided in the manner you request, where it is reasonable and practicable to do so.

When we may refuse access

In limited circumstances, we may refuse a request for access or correction in accordance with the Act. If we do so, we will provide you with written reasons for the refusal and details of how you can complain about the decision.

There is no fee for making a request for access or correction.

10.  Complaints

If you believe we have breached the APPs or handled your personal information inappropriately, you may lodge a complaint with us.

How to lodge a complaint

You may lodge a complaint by contacting our Privacy Officer using the details in Section 12. Please include:

(a)   your name and contact details

(b)   a description of the conduct you believe breaches your privacy

(c)   how you would like us to resolve the complaint

Our process

We will acknowledge your complaint within 7 days and investigate it promptly. We aim to resolve complaints within 30 days. If we need more time, we will let you know and provide an updated timeframe.

11.  Data breaches

We have procedures in place to detect, respond to, and recover from data breaches. In the event of a breach involving personal information, we will take the following steps:

1.     Promptly assess the nature and extent of the breach, including what information has been compromised and the potential consequences for affected individuals.

2.     Take immediate steps to contain the breach and mitigate its effects, including securing affected systems and preventing further unauthorised access.

3.     Notify affected individuals as soon as practicable where the breach is likely to result in serious harm, including information about the breach, the types of information involved, and steps individuals can take to protect themselves.

4.     Report eligible data breaches to the OAIC in accordance with the Notifiable Data Breaches scheme under Part IIIC of the Act.

5.     Maintain records of the breach and conduct a review of our practices to prevent recurrence.

An eligible data breach occurs when there is unauthorised access to, disclosure of, or loss of personal information that is likely to result in serious harm, and we have been unable to prevent the risk of serious harm through remedial action.
